Hi everyone! Today I want to discuss some information about the lawsuit! So, let’s get started, shall we?! So, Disneyland apparently has taken a hit with a lawsuit over its annual pass replacement. Disneyland Resort’s Magic Key Program was designed to replace the theme park resort’s Annual Passport program, when that was cancelled during the pandemic closure of the park. And while the new system was largely identical to the old system, the few changes have caused a number of problems for the guests that use it. And now those problems have resulted in a lawsuit as a bay area woman is actually suing Disneyland over the lack of access. Santa Clara County resident Jenale Nielsen is suing Disneyland Resort for $5 million for breach of contract, negligent misrepresentation, concealment, false advertisement, and unfair competition. Nielsen purchased the Dream Key, an annual pass that advertised access to the park every day of the year. However, due to the park’s reservation system, which limited the number of Magic Key holders who could enter the park each day, she was still unable to get into the parks. She eventually purchased a single-day ticket in order to get into the resort on the day she requested, despite having her pass.

Disneyland’s Response to The Lawsuit

The issue at hand is one that many Disneyland Resort Magic Key holders have previously been upset with. The reservation system splits itself into two groups, one for Magic Key holders, and another for standard ticket buyers. We’ve seen it happen often in the holiday season that Magic Key reservations sell out, while there are still reservations available for normal ticket buyers. A Disneyland spokesperson told the Los Angeles Times…

    “We have been clear about the terms of the Magic Key product and we know that many of our guests are enjoying the experiences these passes provide. We will vigorously defend our position as the case proceeds.”

It’s certainly true that the situation regarding reservations was a known issue from the beginning. It was made clear that even if you tried to visit the parks on a day your Magic Key was not blacked out, that it was still subject to available reservations. What was not clear at the beginning was how available those reservations would be. The lawsuit was originally filed in November in Orange County but was recently moved to U.S. District Court because it is looking to obtain class action status, and represent all Magic Key holders in court. Disneyland Resort stopped selling the Dream Key in October and the step-down option, the Believe Key began to be listed as sold out a month later.

The Problem with Disneyland’s Magic Key Program

It will be interesting to see how this plays out. On the one hand, the Magic Keys were absolutely sold with the knowledge that reservations were required, and that those reservations were not guaranteed. At the same time, it could be argued that the people buying the pass that offered entry every day of the year had an expectation of entry unless the park was at full capacity, and since normal tickets were available those days, it clearly was not. While Annual Passes are a normal part of most theme park business, it’s been clear for a while that there’s been a concerted effort to shift Disneyland’s primary guest from the Southern California local with an annual pass to the vacationing family. There were an estimated 1 million Annual Passports sold under the old system and they made up perhaps as much as half of the park’s total guests, thus being a major part of why Disneyland was so crowded. However, they are seen as less lucrative as they spend less money inside the park than the tourist guest does. If nothing else, this lawsuit shows the frustration that some are having with the Magic Key program. We’ll certainly be following this as, if the lawsuit happens to be successful, it could end up making major changes to the Magic Key program.

Week 15 Team Pick Updates and Week 16 Picks!

Hi everyone! Today I want to discuss which picks I got correct and which ones I got wrong! So, let’s get started! I predicted that the Bills would beat the Panthers 29-18, but the final score was 31-14 Bills over the Panthers. I predicted that the Cowboys would beat the Giants 30-19, but the final score was 21-6 Cowboys over the Giants. I predicted that the Dolphins would beat the Jets 27-10, but the final score was 31-24 Dolphins over the Jets in a close game. I predicted that the Bengals would beat the Broncos 30-24, but the final score was 15-10 Bengals over the Broncos in a close game and a low scoring game. I predicted that the 49ers would beat the Falcons 27-23, but the final score was 31-13 49ers over the Falcons. I predicted that the Raiders would beat the Browns 24-17, but the final score was 16-14 Raiders over the Browns. I predicted that the Vikings would beat the Bears 29-26, but the final score was 17-9 Vikings over the Bears. I predicted that the Rams would beat the Seahawks 27-24, but the final score was 20-10 Rams over the Seahawks.

I predicted that the Titans would beat the Steelers 31-24, but the final score was 19-13 Steelers over the Titans. I predicted that the Cardinals would beat the Lions 34-17, but the final score was 30-12 Lions over the Cardinals in an upset. The Cardinals offense was not able to get anything going because they ran the ball only 3 times. They could not get in the endzone until towards the 4th quarter. They allowed the Lions to run all over them and blow them out of the water. How do you lose to a 1-win team?!! Unbelievable!!! They had a shot to clinch a playoff spot again last week, but failed again. You have to show that you are a playoff team! I predicted that the Ravens would beat the Packers 31-28, but the final score was 31-30 Packers over the Ravens. The Ravens were trying to go for the win on the 2-point conversion, but they failed just short. They also fall to the number 4 seed. I predicted that the Buccaneers would beat the Saints 33-26, but the final score was 9-0 Saints over the Buccaneers in a shutout and a low scoring game. The Saint’s defense was absolutely outstanding and that caught the fans of the Buccaneers stunned and Tom Brady and Bruce Arians! I predicted that the Football Team would beat the Eagles 30-23, but the final score was 27-17 Eagles over the Football Team.

So, I have gotten 8 out of 13 picks correct!! Now, let’s get to week 16 picks, shall we?! The first game tomorrow that I will predict is the Browns @Packers game. I think the Packers would beat the Browns in a close game 30-23. The Packers may have clinched their playoff berth as they will win their division. The next game I will predict is the Colts @Cardinals game. Everything is at stake for the Cardinals tomorrow night! The Cardinals are going to be facing a real test of the Colts running game with Jonathan Taylor who is a dangerous running back in the backfield. The Cardinals have to get off to a good start, stop the run, pressure the quarterback, run the ball more to set up play action, score touchdowns, make the Colts one-dimensional. The Colts offense and defense are very good and that’s why they are red hot right now. This would not be the time to play the Colts if you’re the Cardinals. The Cardinals are continuing to struggle at home this season. They can clinch their first playoff berth with a win over the Colts and it would be a really good Christmas wish. The problem is that the Cardinals just can’t do it. So, what does this mean? This should be a pretty good game. I have to be honest about this game. I want to say the Cardinals would beat the Colts; however, I unfortunately am going to actually pick the Colts to beat the Cardinals in this one 27-24. I’m just not that confident in the Cardinals as of now. If they can prove me wrong, then great. But right now, I don’t see that happening unless they can catch a break with other teams losing on Sunday. The next game I will predict is the Rams @Vikings game. I think this should be a pretty close game. I do think the Rams will beat the Vikings in a close game 30-27 because the Vikings may find a way to lose this game for sure. The next game I will predict is the Giants @Eagles game, the divisional rivalries. I think the Eagles will beat the Giants 34-13. The next game I will predict is the Bills @Patriots game, the divisional rivalries. I think this should be a great game. I think the Bills may actually beat the Patriots this time in a close game 31-27 because they came pretty close to beaten the Patriots last time. The next game I will predict is the Ravens @Bengals game, the divisional rivalries. I think this should be a great game as well. I’m going to give the edge to the Bengals over the Ravens 24-17 because the Ravens seem to be falling and they are not playing like they always have been which should worry the Raven fans here. The next game I will predict is the Chargers @Texans game. I think the Chargers will beat the Texans 42-24. The next game I will predict is the Buccaneers @Panthers game, the divisional rivalries. I think the Buccaneers will beat the Panthers in a close game 35-28. The next game I will predict is the Bears @Seahawks game. I think the Seahawks will beat the Bears 24-13. The next game I will predict is the Broncos @Raiders game, the divisional rivalries. I think this should be a great game! I think the Raiders will beat the Broncos in a close game 23-20. The next game I will predict is the Steelers @Chiefs game. I think the Chiefs will beat the Steelers in a close game 38-30. The Chiefs are just riding high right now. The next game I will predict is the Washington Football Team @Cowboys game, the divisional rivalries on Sunday Night Football. I think this should be a really good game as these teams are fighting for their playoff spots, although the Cowboys just clinched their first playoff spot after the 49ers lost last night. I think the Cowboys will beat the Football Team in a close game 34-27. The last game I will predict is the Dolphins @Saints game on Monday Night Football. I think this may actually be a close game. I think the Saints will do enough to beat the Dolphins in a close game 32-26.

Six Chilling Movies to Watch This Winter

It’s officially winter, and it’s time for some gripping stories to keep you entertained while you retreat from the cold. 

Here are some dark, wintery titles to check out this season. 

The Shining (1980)

Even though the author of the book this film is based on, Stephen King, isn’t much of a fan, The Shining is one of the greatest horror movies of all time. It follows writer Jack Torrance (Jack Nicholson) as he takes the position of the off-season caretaker at the Overlook Hotel. He’s joined by his wife Wendy (Shelley Duvall) and their “gifted” son Danny (Danny Lloyd), who is particularly susceptible to the hotel’s supernatural influence. The version of Jack in the novel is much less sinister than Nicholson’s take, but watching the character progressively lose his sanity is truly terrifying. I also suggest checking out Doctor Sleep, the 2019 sequel. 

Why it’s perfect for winter: Winter in Colorado means snow upon snow upon snow. 

The Shining is available to stream on HBO Max

I’m Thinking of Ending Things (2020)

Based on Iain Reid’s novel of the same name, I’m Thinking of Ending Things follows a young woman (Jessie Buckley) traveling with her boyfriend Jake (Jesse Plemons) to meet his parents for the first time. It seems like a simple plot, but when the couple arrives at Jake’s family home, things get increasingly weird. Toni Collette and David Thewlis deliver brilliant performances as Jake’s unpredictably bizarre parents. Collette’s hysterical laughter that transitions into weeping is masterful. It’s easily my favorite film from 2020 and perfect for winter viewing. I also highly recommend reading the novel. 

Why it’s perfect for winter: A snowstorm plays a big part in the film, especially some of the stranger moments. 

I’m Thinking of Ending Things is available to stream on Netflix

Climax (2018)

In this Gaspar Noé psychological horror film, Selva (Sofia Boutella) and her dance troupe hold an after-party in an abandoned school. All is well until the LSD-spiked sangria kicks in, sending everyone into their own hellish trip. Boutella leads an ensemble cast of twenty-four, most of whom are professional dancers with no acting experience. Noé cast dancers from different backgrounds — voguing, krumping, and others I’m not sure how to categorize. The blend of styles works amazingly well, and their choreography is nothing short of hypnotizing. It’s a film that you’ll wish you could see for the first time over and over again. 

Why it’s perfect for winter: Noé loosely based the film on real events in Paris in winter 1996, which is also the setting for the film. In their drugged state, some dancers venture out into the snow and don’t return.

Climax is available to stream on Prime Video (via a Showtime subscription).

Black Swan (2010)

Speaking of dance films, Darren Aronofsky’s Black Swan takes us into the psyche of a paranoid ballet dancer. Nina Sayers (Natalie Portman) is perfect for the role of the innocent White Swan in the New York City Ballet’s production of Tchaikovsky’s Swan Lake. However, the company’s artistic director Thomas Leroy (Vincent Cassel) doubts her ability to also play the seductive Black Swan. The casting coincides with the arrival of Lily (Mila Kunis), who embodies the dark qualities of the Black Swan. All the pressure to land and maintain her dual role in Swan Lake sends Nina spiraling to the point that she loses her handle on reality. 

Why it’s perfect for winter: The classical music, beautiful costumes, and wintry NYC setting make for prime seasonal viewing, but I strongly recommend watching it anytime of year.

Black Swan is available to stream on Hulu.

Let the Right One In (2007)

Let the Right One In isn’t your conventional vampire film. Instead of a sultry adult vamp, we have Eli (Lina Leandersson), who looks like a young girl. But she can kill humans with the best of them. She and an older man, Håkan (Per Ragnar), move into an apartment in Stockholm where she meets 12-year-old Oskar (Kåre Hedebrant), their next-door neighbor. Oskar is relentlessly bullied at school and has no friends. Eli goes through life only with the company of Håkan (who is essentially her familiar). The two lonely kids form a bond, one that’s powerful especially for their age. It’s a beautifully written love story with frightening imagery. The American remake Let Me In is worth a watch, too. 

Why it’s perfect for winter: The film is set in winter, and the icy landscape goes perfectly with the bloody, undead subject matter.

30 Days of Night (2007)

A town in Alaska that goes without sun for 30 days? If that’s not the most ingenious premise for a vampire film, I don’t know what is. Based on Steve Niles’ comic book series, 30 Days of Night follows the residents of Barrow, Alaska, as they prepare for the annual month-long darkness. After a group of vampires descends upon the town, Sheriff Eben Oleson (Josh Hartnett) and his estranged wife Stella (Melissa George) fight to protect their town. Marlow (Danny Huston) leads his vampire brethren in an all-out bloodbath. The film stays true to Ben Templesmith’s illustrations, depicting the vampires as horrifying monsters.
